Request Release of Funds

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Star City, Arkansas.
REQUEST FOR RELEASE OF FUNDS
On or after the 27 th of January 2024 the City of Star City, Arkansas will submit a request to the Arkansas Economic Development Commission for the release of ACEDP funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project:
Project Title: Food Pantry
Purpose: Provide food for low-income residents in a safe place
Location: The project is located at 303 Wiley Street Star City, Arkansas
Project Description: A new building will be constructed for the Food Pantry and the existing building will be demolished
Project Issues: No issues exist that need mitigation
Mitigation Measures/Conditions/Permits (if any): No mitigation is required, and only local building permits will be needed
Estimated Project Cost: AEDC will provide $300,000.00 for the project. The remaining will be provided through USDA and DRA. The total is estimated to be $540,000.00
FINDING OF NO SIGNIFICANT IMPACT
The City of Star City has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Star City’s City Hall located at 200 South Jefferson Star City, Arkansas 71665, and may be examined or copied weekdays 9:00 A.M to 3:00 P.M.
Any individual, group, or agency may submit written comments on the ERR to the Star City Mayor. All comments received by January 26, 2024, will be considered by the City of Star City prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Star City certifies to Arkansas Economic Development Commission that Paul Carter, Certifying Officer, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Arkansas Economic Development Commission’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Star City to use ACEDP program funds.
OBJECTIONS TO RELEASE OF FUNDS
Arkansas Economic Development Commission will accept objections to its release of fund and Mayor Paul Carter’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:
(a) The certification was not executed by the Certifying Officer of the Mayor of Star City.
(b) The Mayor of Star City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58;
(c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by Arkansas Economic Development Commission; or
(d) Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Grants Management Division, Arkansas Economic Development Commission, 1 Commerce Way, Suite 600, Little Rock, Arkansas 72202. Potential objectors should contact Arkansas Economic Development Commission to verify the actual last day of the objection period.
